Addison Wins Court Ruling…Faces Nii Noi In A Re-election!

He led the NPP as the lead counsel to seek clarification from the Supreme Court in the 2012 Presidential Elections but lost the petition to the ruling National Democratic Congress [NDC] – however his second appearance in court to challenge an election results has been successful.

NPP’s Philip Addison who lost a parliamentary primary in the Klottey Korle Constituency will have the opportunity to prove his competence of wining the seat after an Accra High Court ruling.

The Elephant fraternity according to the court must hold a reelection in the constituency since the previous one was questionable.

The winner of the primaries, Nii Noi Nortey earlier prayed the court to throw away Addison’s petition but that was dismissed.

Mr. Nortey’s joinder motion to be part of the case as the 3rd defendant was overruled – with the court stating that he cannot challenge the default judgment.

Defeated candidates in the August 2, 2015 election, Philip Addison and Nii Adjei Tawiah earlier succeeded in obtaining a default judgment after the NPP, 1st defendant failed to enter an appearance in court.

In court, counsel for 3rd defendant, Gary Nimako Marfo moved his application for a default judgment to be set aside in court yesterday, but counsel for the plaintiff, Frank Davies responded aggressively by reminding the court that there was no such application to that effect.

Justice Mills-Tetteh after ordering for calmness ruled that Mr. Nortey and his counsel, Gary Nimako Marfo have no case and therefore could not challenge the default judgment since the party to which the judgment was entered against had abandoned it.

The final judgment paves way for the keenly re-run of the election in the Klottey Korle Constituency.
